The
music industry has created a poor reputation for its
handling of contracts and payments. The general trend is toward keeping
things vague. Musicians have never had much choice but to just accept
these conditions. Much of the conflict that arises out of the music
industry finds its source in this vagueness. We wanted to ensure absolute clarity at every level, and to push the musical suppliers to Goemarati to a new level of operation. Most musicians are under the tax radar. Most musicians are unable to send a suitable invoice. Some musicians do not have bank accounts. Some are afraid of contracts. In order for the industry to grow, and for musicians to benefit from that growth, certain key elements must be in place. We wanted to create some of that development with Goemarati. Our process was: 1. approach artist and make offer by email 2. artist expresses interest. Send proposed contract 3. agree on and sign contract 4. Artist issues invoice, with terms laid out as 50% advance and 50% on completion with 7 working days. No invoice, no payment 5. artist receives 50 % advance and is considered confirmed 6. artist performs both shows 7. artist receives balance of payment due Many artists had to send several invoices before they sent a legal document. Some sent scant detail in email without banking details. This is a level of the industry that is wanting, and that it is important artists are able to receive advice about in order to better sustain themselves. The contracts were critical for recording and filming to ensure that there was consent and that the rights and ownership were clear. All contracts were signed between the artists and Iain Harris, representing Coffee Beans Routes. It was not possible to sign Goemarati contracts as it is not a legal entity. Essential contract terms for recording and image rights were: - artist retains ownership of all intellectual property - artist gives Coffee Beans Routes the rights to the audio, still image and video image recordings for promotional purposes: in promotion of Goemarati and the artists - Coffee Beans Routes retains first right of release for a Goemarati product, in the event that all signed parties agree that the material has commercial value |
